Fault for a side impact collision varies according to the circumstances. Unlike rear-end collisions, there is no strong presumption of liability based on the vehicle’s position. Instead, investigators must review the totality of the situation and what led to the crash before deciding.

Some side-impact cases are obvious and one-sided. For instance, if a drunk driver runs a red light and sideswipes a vehicle legally crossing the intersection, there is little room for doubt about who is at fault.
